It's Official - No Men in Women's Sports

The U.S. Supreme Court handed down a landmark decision this past week, ruling that states may limit participation on girls’ and women’s school sports teams based on biological sex.

In a unanimous ruling on the federal statutory questions, the Court determined that laws enacted in Idaho and West Virginia allowing states to restrict men's participation in girls’ and women’s sports do not violate Title IX. The justices were divided, however, on constitutional issues involving one of the challengers, resulting in separate concurring and dissenting opinions.

Writing for the majority, Justice Brett Kavanaugh stated that states may continue to maintain separate athletic teams for biological males and biological females. The opinion concluded that biological differences between the sexes are relevant to athletic performance and that states have important interests in preserving competitive fairness and athlete safety.

The decision centered on laws passed in Idaho and West Virginia that restrict participation on girls’ and women’s sports teams. Idaho became the first state to enact such legislation in 2020, and more than two dozen states have since adopted similar measures.

Justice Sonia Sotomayor, joined by Justices Elena Kagan and Ketanji Brown Jackson, filed a dissent arguing that the Court's decision places an unfair burden on transgender student-athletes and that additional fact-finding should have been allowed in one of the cases before reaching a final constitutional determination. The ruling is expected to have a significant impact on school athletics nationwide, providing states with greater legal certainty when crafting policies governing participation in girls’ and women’s sports. The ruling will go a long way in protecting women's sports against men who want to compete against them. 

The Supreme Court's decision marks one of the most significant rulings involving scholastic sports in recent years and will likely influence athletic policies across the country for years to come.
