Chocolate Manufacturer Accused of Selling Contaminated Products

A class action lawsuit has been filed against a prominent chocolate manufacturer for allegedly selling contaminated products. Jana Rabinowitz, representing herself and others similarly affected, lodged the complaint in the United States District Court for the Eastern District of New York on February 17, 2026, targeting Spring & Mulberry, Inc.

The lawsuit accuses Spring & Mulberry of deceptive practices related to their chocolates, which were allegedly contaminated with Salmonella. The plaintiff claims that the company failed to disclose this risk on their packaging, misleading consumers into believing the products were safe. According to the complaint, Salmonella can cause severe health issues, particularly in vulnerable populations such as young children and the elderly. The issue came to light when Spring & Mulberry issued a voluntary recall of their Mint Leaf flavor chocolate bars on January 12, 2026, which was later expanded to include additional flavors produced on the same equipment.

Rabinowitz argues that consumers like herself expected these premium-priced chocolates to be free from harmful substances. She highlights that Spring & Mulberry's marketing emphasized health benefits and quality ingredients without warning about potential contamination risks. The plaintiff contends that this omission is material because it affects consumer purchasing decisions and alleges violations of New York General Business Law §§ 349 and 350 concerning deceptive acts and false advertising.

The lawsuit seeks various forms of relief including monetary damages exceeding $5 million, restitution for unjust enrichment by the defendant, and injunctive relief to prevent further misleading marketing practices. Rabinowitz also calls for punitive damages due to what she describes as willful misconduct by Spring & Mulberry.
