A New York resident has filed a lawsuit alleging severe misconduct by several legal professionals, including a Supreme Court Justice, in a case involving alleged fraud and deprivation of parental rights. Giuseppe Lubrano initiated the complaint on January 26, 2026, in the United States District Court for the Eastern District of New York against Sharon A.B. Clarke and other defendants.

Lubrano's lawsuit centers around claims that his constitutional rights were violated through fraudulent actions during matrimonial proceedings. He accuses several attorneys and a judge of conspiring to deprive him of property and parental rights without due process. The complaint details how false statements and ex parte communications led to unfavorable court orders against him, affecting his visitation rights with his child and resulting in the loss of his home. "The defendants acted under color of state law to orchestrate ex parte alterations to judgments," Lubrano asserts, citing violations under 42 U.S.C. § 1983 for deprivation of due process and parental rights.

The complaint narrates a series of events where Lubrano alleges he was misled by false claims made by attorneys representing his ex-wife, Ekaterina Protas. He accuses Mary Grace Condello of making unsubstantiated abuse allegations that resulted in the suspension of his visitation rights without proper hearings or evidence. Furthermore, Lubrano claims that Judge Sharon A.B. Clarke failed to address these fraudulent actions adequately and instead perpetuated them by issuing orders based on misleading information.

In addition to seeking declaratory relief from the court to recognize these violations, Lubrano is pursuing compensatory damages amounting to $2 million per defendant for losses incurred due to property misappropriation and damage to his credit standing. He also seeks punitive damages totaling $200,000 against each defendant for what he describes as years wasted fighting against these injustices.

Representing himself pro se, Lubrano demands a jury trial on all issues triable by jury while requesting attorney fees under 42 U.S.C. § 1988 should he prevail in this case. The legal proceedings are overseen by Judge Ketnurer under Case ID 1:26-cv-00487.
