Warehouse safety manufacturer DK Gentile & Company alleges trade secret misappropriation by distributor

DK Gentile & Company Inc., a manufacturer of warehouse safety systems, has filed a lawsuit against Global Industrial Distribution Inc. and Global Equipment Company Inc., alleging the misuse of proprietary information to develop and sell competing products. DK Gentile claims the defendants breached contractual obligations by using confidential information to create similar warehouse safety devices.

According to the complaint, DK Gentile developed warehouse safety products including the “Look Out 3 Rack” and “Look Out 4,” which were marketed through a vendor agreement with the defendants beginning in 2015. DK Gentile alleges that the defendants later invited the company to participate in a Marketing Development Fund program intended to increase online product visibility. The lawsuit claims that proprietary information shared during training sessions and through the program was instead used to develop competing products sold under the defendants’ brand.

The complaint states that in early 2024, Global Industrial began selling two products identified as Part Numbers WB641664 and WB641665, which DK Gentile alleges closely resemble its own designs. DK Gentile claims that the introduction of these products led to a substantial decline in its sales, with average quarterly revenue decreasing from $171,928 to $8,086 by the third quarter of 2025.

DK Gentile is seeking monetary damages exceeding $478,395 for alleged lost sales, as well as additional damages for ongoing losses estimated at $687,712 per year. The company also seeks injunctive relief to stop further sales of the disputed products, disgorgement of profits, and compensatory damages related to alleged breach of contract and misappropriation of trade secrets under New York law.

The plaintiff is represented by attorneys Adam Michael Levy and Emma Sibony of Levy Goldenberg LLP. The case was filed in the United States District Court for the Eastern District of New York under 2:25-cv-06810.
