New York man sues medical device company over injuries from allegedly defective vein filter implant

A New York resident has filed a lawsuit against major medical device company Becton, Dickinson and Company (BD), along with its subsidiaries C.R. Bard, Inc., and Bard Peripheral Vascular, Inc., alleging severe injuries from a defective medical implant.

The lawsuit filed by plaintiff Justin Moundas revolves around the alleged defects in the defendants’ Bard G2 Filter System, an inferior vena cava filter designed to prevent blood clots. Moundas claims that he suffered significant injuries after being implanted with the medical device in 2007. According to the complaint, these filters were marketed as safe devices for preventing pulmonary embolism by catching blood clots traveling from the lower body to the heart and lungs. However, Moundas states that after undergoing a CT scan on April 22, 2022, it was discovered that parts of his filter had extended beyond his inferior vena cava wall. Subsequent medical procedures revealed fractured struts remaining in his body even after attempts at removal. The lawsuit claims these complications have led to ongoing physical pain and emotional distress for Moundas.

Moundas alleges that BD and its subsidiaries misrepresented the safety of these filters despite knowing they were prone to fracturing, migrating within the body, and perforating veins. Moundas argues that BD and its subsidiaries failed to adequately warn patients and healthcare providers about these risks.

The complaint details various alleged violations by BD and its subsidiaries concerning federal regulations governing medical devices. It accuses them of failing to adhere to good manufacturing practices and not conducting adequate testing before marketing their products. Moundas seeks compensatory damages exceeding $75,000 for his injuries and punitive damages due to what he describes as willful negligence by the defendants.

Moundas is represented by attorney Robert T. Wright of the Wright & Associates Law Firm. The case was filed in the United States District Court for the Eastern District of New York under Case ID 1:25-cv-02213 and is presided over by Judge John P. Smith.
