Plaintiff (custom plush maker) sues Defendant (online retailer) over False Advertising

CC Brand Holdings, LLC has filed a lawsuit against Diamonds Painting, Inc., operating as Petslify, and its principal Niko Dulzhikov. The complaint was lodged in the United States District Court for the Eastern District of New York on January 5, 2026. CC Brand Holdings accuses Petslify of engaging in false advertising and deceptive business practices that violate both federal and state laws.

The plaintiff, CC Brand Holdings, known for its custom pet plush replicas under the brand Cuddle Clones, alleges that Petslify falsely markets itself as a family-owned U.S. manufacturer while actually producing goods overseas. According to the complaint, Petslify's website and marketing materials misleadingly claim their products are "family made in Florida," which is untrue since production occurs in China. This misrepresentation is said to contravene Federal Trade Commission regulations regarding country-of-origin claims.

Furthermore, Cuddle Clones asserts that Petslify has used its copyrighted images and videos without permission to promote competing products. These actions allegedly create consumer confusion about the origin of Petslify’s goods and infringe upon Cuddle Clones’ intellectual property rights. In October 2024, Cuddle Clones discovered this unauthorized use of their content on Petslify’s website and Amazon listings.

In addition to these claims, CC Brand Holdings accuses Petslify of fabricating reviews and endorsements to deceive consumers into believing their products are superior. The lawsuit details how Petslify displays fake security badges and fabricated review scores on its website to enhance credibility falsely. Moreover, it employs deceptive sales tactics such as countdown timers that reset daily to pressure customers into purchasing immediately.

The plaintiff seeks various forms of relief from the court, including injunctive relief to prevent further dissemination of false advertising by Petslify. They also request an order for corrective advertising to mitigate the effects of misleading claims previously made by the defendants. Additionally, CC Brand Holdings demands an accounting of profits earned through these deceptive practices and compensation for damages incurred due to lost sales and reputational harm.
