Patient sues NYU Langone and doctors over alleged aortic dissection misdiagnosis

A New York resident has filed a medical malpractice lawsuit against NYU Langone Hospital-Brooklyn and several affiliated physicians, alleging negligence and lack of informed consent during her medical treatment.

According to the complaint, Stefany C. Rodriguez Valdez sought medical care at NYU Langone Hospital-Brooklyn between June 8 and June 12, 2021, for severe back pain, chest pain, epigastric pain, frequent vomiting, and complications related to labor and delivery that resulted in a cesarean section and post-operative treatment. The defendants named in the case include Drs. George C. Aglialoro, John F. Heitner, Andrew Sackrison, Vuy San Li, Susan H. Cheng, Shilpi Mehta-Lee, and Meleen Chuang, all of whom were affiliated with the hospital as employees or independent contractors.

The lawsuit alleges that the defendants failed to meet accepted standards of medical care, resulting in a delayed diagnosis of an aortic dissection. The plaintiff claims the delay caused serious complications, including visceral ischemia and acute mesenteric ischemia.

Rodriguez Valdez alleges that she suffered significant injuries as a result of the alleged negligence, including cardiomyopathy, abscesses, sepsis with respiratory failure, and the need for surgical procedures such as bowel resection and ileostomy. She also claims that the defendants failed to obtain informed consent by not adequately explaining treatment options and associated risks.

The complaint further alleges that NYU Langone Hospital-Brooklyn engaged in negligent hiring and retention by failing to ensure that its medical staff possessed the necessary skills and competence to provide appropriate patient care.

The plaintiff is represented by attorney Walter Osuna of The Jacob D. Fuchsberg Law Firm. The case was filed in the Supreme Court of the State of New York, Kings County, under Index No. 530481/2023 and is presided over by judges of that court.
