Class action accuses Synchrony Financial of sharing customer data with third parties

A class action lawsuit has been filed against Synchrony Financial, accusing the company of violating privacy laws by sharing sensitive customer information without their consent with third parties.

The lawsuit, filed by plaintiff James Allen, alleges that Synchrony Financial unlawfully intercepted and disclosed private information to LinkedIn and Facebook using embedded tracking technologies on its website, which customers use to apply for credit cards and loans. This integration allegedly allowed these platforms to access sensitive data such as personally identifiable information and financial details of users who believed their interactions were confidential. Allen, who applied for a credit card through Synchrony’s website in May 2025, contends that his information was shared with LinkedIn and Facebook without his knowledge or consent. The complaint asserts that this practice violates the Electronic Communications Privacy Act and New York General Business Law § 349.

According to the complaint, Synchrony Financial assured users that their personal data would not be used to identify them directly but would instead improve their site experience. It is alleged, however, that the company misled consumers by failing to disclose its data-sharing practices with third-party entities. The lawsuit further accuses Synchrony of engaging in deceptive acts by misrepresenting how it collects and uses consumer information.

Allen seeks compensatory damages for all affected class members, disgorgement of profits from the alleged practices, injunctive relief to prevent further violations, statutory damages, attorney fees, and related costs.

The plaintiff is represented by attorneys Philip L. Fraietta and Alec M. Leslie of Bursor & Fisher, P.A. The case was filed in the United States District Court for the Eastern District of New York under Case No. 1:25-cv-06037.
