An Illinois resident has filed a lawsuit against New York car dealership Kings Point Auto, claiming that he was misled into purchasing a vehicle that did not match its advertised condition.
Plaintiff Brian Petereit accuses Kings Point Auto LLC of using bait-and-switch tactics to sell him a vehicle materially different from what was represented. The lawsuit claims the dealership advertised a 2017 Ford F-150 Limited as being in excellent condition and featuring automatic running boards and limited-edition badging. However, upon delivery, Petereit discovered substantial rust and missing features. He further alleges that Kings Point Auto LLC used photographs from a different truck previously sold to market the vehicle he received. The alleged deception was only uncovered after delivery and subsequent investigation.
Petereit brings several claims against the dealership, including fraudulent misrepresentation, breach of contract, breach of express and implied warranties under UCC §§ 2-313 and 2-314, violations of New York General Business Law § 349, and negligent misrepresentation. He seeks compensatory damages totaling $34,970 and punitive damages of at least three times that amount, along with statutory damages under GBL § 349.
The complaint describes the dealership’s conduct as deliberate and misleading, involving the use of false photographs and inaccurate representations regarding the truck’s features and condition. Petereit argues that the actions warrant punitive damages due to their willful and deceptive nature.
