Woman files lawsuit against CarMax alleging that her vehilce was unlawfully seized

A woman has filed a lawsuit against multiple defendants, including an automotive retailer and repossession companies, alleging the unlawful repossession of her vehicle.

The lawsuit filed by plaintiff Maridanielle Annicchiarico names CarMax, Inc., MV Recovery LLC d/b/a MVTRAC, Dezba Asset Recovery Inc., Dean Annicchiarico, Jillian Resnikoff, and an unnamed individual as defendants. According to Annicchiarico, on May 31, 2025, her 2019 Mercedes-Benz was repossessed without proper authorization from a hotel parking lot in Islandia, New York. She states that the tow agent did not present a valid repossession order or identification and did not allow her to retrieve prescription medications for her daughter, Sophia. At the time, Annicchiarico and her children were traveling out of state for a hockey event involving her son, Gianni.

According to the complaint, Annicchiarico contacted CarMax and MV Recovery to resolve the situation but encountered difficulties due to weekend office closures and insufficient documentation regarding the repossession. The complaint also alleges that a lack of emergency contact options further complicated their efforts to locate the vehicle.

Annicchiarico alleges that Dean Annicchiarico and Jillian Resnikoff were involved in facilitating the repossession and used location-tracking applications to monitor her movements. The complaint claims the defendants had prior knowledge of the vehicle’s location and that the incident is linked to longstanding family disputes dating back to 2014.

The plaintiff is seeking compensatory damages exceeding $75,000 for emotional distress and financial losses. She also seeks punitive damages, injunctive relief to preserve relevant evidence, and statutory damages under New York law.

The case was filed in the United States District Court for the Eastern District of New York under Case ID 2:25-cv-03665-SJB-ARL and is presided over by Judge Sanket Bulsara.
