United Beauty Brands accused of violating telemarketing laws by sending unsolicited text messages

A class action lawsuit has been filed against beauty brand United Beauty Brands, LLC, for allegedly sending unsolicited marketing text messages during hours prohibited by federal telemarketing laws.

The complaint filed by plaintiff Kennedy Didier claims that Ouai sent multiple text messages promoting its products before 8 a.m. or after 9 p.m., in violation of the Telephone Consumer Protection Act (TCPA) of 1991, which restricts telemarketing communications during those hours.

The complaint states that  Ouai sent promotional texts advertising its Detox Face Cleanser and Scalp Serum at 12:16 a.m. and 10:46 p.m., respectively. Didier alleges that these messages were part of a broader marketing campaign and were sent in violation of the TCPA’s time-of-day restrictions.

Didier is pursuing the case as a class action under Federal Rule of Civil Procedure 23. The proposed class includes individuals in the United States who received more than one marketing text from Ouai during prohibited hours within any twelve-month period in the past four years. The complaint asserts that a class action is the most practical method for resolving these claims, given the number of potentially affected individuals and the cost of individual litigation.

The lawsuit seeks statutory damages ranging from $500 to $1,500 per violation, depending on whether the violations are found to be negligent or willful. Didier also seeks injunctive relief to stop any further alleged violations and requests attorney fees and litigation costs.

The plaintiff is represented by attorney Zane C. Hedaya of The Law Offices of Jibrael S. Hindi. The case was filed in the United States District Court for the Eastern District of New York under case ID 1:25-cv-03632.
