71-year-old man sues NYPD, hospital, and landlord over eviction and alleged abuse

A 71-year-old man is suing Flushing Hospital Medical Center, Dajin Realty Inc., the City of New York, and NYPD officers, alleging a series of abuses that caused him physical and emotional harm. 

According to the complaint filed by plaintiff Changhe Cheng, on March 6, 2024, Cheng was subjected to an unlawful eviction attempt by his landlord at Dajin Realty. Cheng claims that although he offered a cashier’s check for $68,963 to resolve outstanding debts—a transaction he states was captured on video—the payment was refused, and he was locked out of his home. When NYPD officers arrived, they allegedly entered his residence without a warrant or consent and arrested him using excessive force. According to the complaint, Cheng told officers, “I cannot walk far,” as they took his cane and worsened an existing finger injury.

Cheng further alleges that Flushing Hospital improperly discharged him despite ongoing medical needs and granted NYPD officers unauthorized access to his medical records. He also claims that he was denied food for nearly two days while in police custody and suffered additional injury due to overly tight handcuffs.

The complaint lists multiple claims under 42 U.S.C. § 1983, including unlawful entry, false arrest, excessive force, and malicious prosecution by NYPD officers John Does 1–5 and Dajin Realty Inc. It also alleges medical malpractice and breach of fiduciary duty by Flushing Hospital. Cheng seeks at least $10 million in compensatory damages for physical and emotional harm.

Cheng is seeking punitive damages against individual defendants, alleging their conduct was intended to conceal their actions through false charges, including criminal trespass, which was later dismissed.

The plaintiff is representing himself in this case. The case was filed in the United States District Court for the Eastern District of New York under Case No. 25-CV-3286-HG-JRC and is presided over by Judge Hector Gonzalez.
