Class action lawsuit filed against Cybex and Columbus Trading-Partners over defective infant car seats


A class action lawsuit has been filed against Cybex GmbH and Columbus Trading-Partners USA Inc., alleging that they sold rear-facing infant car seats with a dangerous defect that could lead to severe injury or even death.

According to the lawsuit filed by plaintiff Sarah ElSayed, the defendants manufactured and sold defective rear-facing infant car seats under the Aton G model line between February 20, 2023, and May 10, 2024. These car seats allegedly have harness anchor pins that can dislodge due to deformation when sliding over sharp edges. This defect can cause the harness to detach at the hip anchor, leaving infants unrestrained during use or in a crash. Despite advertising these products as safe and high-quality, ElSayed argues that the defendants knowingly sold unsafe products while misleading consumers about their safety standards.

ElSayed's lawsuit highlights a voluntary recall issued by Cybex on February 14, 2025, affecting approximately 23,000 units of various Aton G models. However, she contends that this recall is inadequate because it fails to reach all affected consumers and does not offer a sufficient remedy for those who purchased these defective products. Instead of recalling the entire product or offering replacements or refunds, Cybex plans to provide registered owners with a repair kit starting April 4, 2025. This kit requires consumers to install it themselves without professional verification of its effectiveness.

In her legal filing, ElSayed accuses Cybex GmbH and Columbus Trading-Partners USA Inc. of violating New York General Business Law §§ 349 and 350 by engaging in deceptive acts and practices through false advertising. She also claims breaches of express and implied warranties regarding the safety and quality of their products. The plaintiff seeks monetary damages for herself and other class members who purchased these defective car seats during the applicable statute of limitations period. She demands compensation for financial losses incurred from purchasing unsafe products at premium prices.

The plaintiff is represented by attorneys James R. Denlea, Jeffrey I. Carton, and Catherine H. Friesen from Denlea & Carton LLP based in White Plains, New York. The case was filed in the United States District Court for the Eastern District of New York under case Civil Action No: Case 1:25-cv-01347.
