A woman has filed a lawsuit against former employers, New Castle Hotels, LLC and Riverhead East End Hotel Management LLC. Plaintiff Elexa Page accuses these entities of sex and pregnancy discrimination, citing violations under Title VII of the Civil Rights Act of 1964 and the New York State Human Rights Law.
The complaint details Page's employment experience as a Breakfast Ambassador at the Residence Marriott Long Island East End from June 9, 2023, to June 8, 2024. During her tenure, Page alleges that she was subjected to a hostile work environment fostered by sexual harassment from her direct supervisor, Robert Abreu. Despite reporting this behavior to Robert Shear, the hotel's General Manager, no corrective actions were taken. "Abreu’s actions were designed to satisfy his prurient interests," states the complaint, describing how he repeatedly intruded upon Page while she expressed breast milk in an inadequate space provided by the hotel.
Page's allegations extend beyond personal harassment; they accuse her employers of failing to comply with legal obligations under both federal and state laws. According to the Fair Labor Standards Act (FLSA) and New York Labor Law (NYLL), employers are required to provide a private space for nursing mothers that is not a bathroom. However, instead of providing such accommodations, Page claims that she was forced to use Abreu's office for this purpose—a situation that led to further invasions of privacy.
The complaint details how anxiety and stress from these experiences affected her ability to perform her job duties and fulfill her responsibilities as a new mother.
Page is requesting s back pay with interest for lost earnings due to constructive discharge caused by intolerable working conditions. Additionally, she demands compensatory damages for emotional distress suffered during this period and punitive damages aimed at penalizing the defendants' conscious disregard for her rights.
