Lawsuit alleges police misconduct against NYPD officers following arrest incident

A lawsuit has been filed against the New York City Police Department, alleging police misconduct and civil rights violations. 

Jonathan Sharrock filed the complaint on Dec. 27, 2024, in the United States District Court for the Eastern District of New York, naming the City of New York and several police officers, including Officer Christopher Mott. The lawsuit alleges excessive force and malicious prosecution by the NYPD.

According to the complaint filed by Sharrock's attorney, Brett H. Klein, the incident occurred on Sept. 30, 2023, at 131-16 Merrick Blvd in Queens, when Sharrock witnessed police activity. 

After requesting access to his vehicle and asking for an officer's name and badge number, Sharrock claims he was ordered to be arrested by a sergeant without probable cause. 

The situation escalated, and Sharrock alleges he was slammed to the ground, handcuffed, and taken into custody. His injuries, including a subdural hemorrhage and nasal bone fracture, required medical attention at Jamaica Hospital Medical Center.

The lawsuit outlines that Sharrock was charged with false offenses based on fabricated evidence allegedly created by Officer Mott and others involved in the arrest. These charges led to his imprisonment until Oct. 1, 2023, when he was arraigned in Queens County Criminal Court. 

The case continued until March 12, 2024, when all charges were dismissed and sealed. Sharrock argues that the officers acted with malice and that their actions reflect broader systemic issues within the NYPD, including inadequate training and supervision.

Sharrock seeks compensatory damages for physical injuries and emotional distress under federal law (42 U.S.C. §1983) for violations including false arrest and excessive force. He also seeks punitive damages against individual defendants for their alleged misconduct. 

Additionally, Sharrock aims to hold the City of New York accountable for its failure to properly train its police force, which he claims led to the violation of his civil rights.
