Lawsuit alleges security firm Platinum Protection Services violated wage laws

A former employee has filed a lawsuit against his previous employers, accusing them of violating labor laws. Kyle Boiko filed a complaint in the U.S. District Court for the Eastern District of New York on December 19, 2024, naming Samori Samad, Anthony Wigfall, and Platinum Investigations Inc., doing business as Platinum Protection Services. 

The lawsuit alleges the defendants failed to comply with federal and state labor regulations.

The complaint, filed by Boiko through attorney Jon A. Stockman of The Law Office of Jon A. Stockman, claims multiple breaches of the Fair Labor Standards Act (FLSA) and New York Labor Law (NYLL).

According to Boiko, during his employment with Platinum Protection Services, a security company providing personnel to various clients, he was not paid according to the agreed terms or legal requirements. 

Boiko asserts that, despite an agreement to be paid $21.75 per hour for services at East Hampton High School and other locations, he was frequently paid less than that rate and sometimes below the minimum wage.

Boiko’s claims also include instances where he was not paid at all for certain work weeks, notably the week of November 20-27, 2023. Additionally, he alleges that the defendants failed to provide the required wage statements or notices, as mandated by NYLL sections 195(1)(a) and 195(3), making it unclear whether he was being paid correctly.

During his employment from February to November 2023 at various locations, including East Hampton High School and Belmont at Eastview Apartments in Central Islip, NY, Boiko reports consistent issues with payment timeliness and accuracy. 

His role involved significant physical activity—standing or walking more than 25% of his workday—which, he argues, required timely weekly payments under NYLL section 191(1)(a).

The lawsuit seeks unpaid wages, liquidated damages equal to those wages under both FLSA and NYLL provisions, damages for the lack of proper wage statements, compensation for untimely payments, litigation costs, attorney’s fees, and pre- and post-judgment interest.
