Plaintiff alleges negligence and fraud against professional corporation over asset obstruction

A recent court filing has brought to light serious allegations of negligence, fraud, and conspiracy involving a professional corporation and its associates. The complaint was filed by Matteo Patisso, the assignee of Liquid Brick, Inc.'s claims, in the United States District Court for the Eastern District of New York on September 6, 2024, against J. Scott Souders, P.C.

According to the complaint, Plaintiff Matteo Patisso seeks redress for financial damages resulting from the Defendant's actions that allegedly obstructed his rightful claims to certain assets currently held by Kings Auctions, Inc., a client of the Defendant. The assets in question include The Michael Jackson Sketch Library of Art a/k/a The Museum Collection (“MJ Art”). Patisso claims that despite having clear legal rights to these assets and incurring expenses with the Los Angeles U.S. Marshal's office to seize them, the defendant's actions through its colleague Kathy Moore thwarted his efforts.

The plaintiff accuses the defendant of directing their client, Kings, not to cooperate with him on grounds that they were cooperating with Vinson Investments, LLC—an unsecured creditor—and their lawyers in a conspiratorial effort to re-list the plaintiff’s property for public auction. This alleged scheme aimed at benefiting Vinson and Kings financially while disregarding the plaintiff’s legal rights. Despite multiple opportunities to cease their obstruction or justify their actions legally, the defendant continued to hinder the plaintiff’s attempts to reclaim his property.

Patisso further alleges that these deliberate actions amount to negligence, fraud, and conspiracy to defraud. He asserts the defendant's false representations and material omissions were intended to deceive him and obstruct justice. Moreover, he claims the defendant’s threats of legal reprisal violated his First Amendment right to petition the government for redress of grievances.

In seeking judgment from the court, Patisso requests an award of damages in an amount determined at trial or following a judgment in favor of his Motion for Summary Judgment. He also seeks compensatory and punitive damages along with costs including reasonable attorney’s fees. Additionally, he demands a jury trial on all triable issues but excludes those resolved via summary judgment or appellate review.

The case is being overseen by Judge Gary R. Brown and Magistrate Judge Arlene R. Lindsay. Case ID 2:24-cv-06297-GRB-ARL.
